It allows the vice president and a majority of senior executive officials to declare that a sitting president is unable to carry out the responsibilities of the office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution also allows Congress to establish an independent commission that could take the place of those officials in assessing a president&#8217;s ability to serve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The idea is not entirely new. In 2020, former House Speaker Nancy Pelosi and Representative Jamie Raskin introduced legislation proposing a 17-member commission made up of medical professionals and former government officials. However, the proposal never advanced through Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With Democrats expected to gain control of both chambers in January 2027, the proposal could receive renewed attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But establishing such a commission would not automatically remove Trump from office. Under the 25th Amendment, Vice President JD Vance would have to participate in the declaration. Trump could also challenge the decision, requiring a two-thirds majority in both chambers of Congress to keep the transfer of power in place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That high threshold would make the process extremely difficult.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For now, Democratic leaders have not committed to pursuing this route.
